The website located at gwcoin.com is maintained by Magdalena Burzyńska trading as GW COIN Magdalena Burzyńska registered in the Business Activity Central Register and Information Record (CEIDG) kept by the minister in charge of economy, principal place of business and address for service: ul.   2. These Terms and Conditions shall govern all use of gwcoin.com by all Users and is intended only for Entrepreneurs (non-consumer user).

  3. These Terms and Conditions set forth: the type, scope and conditions of: rendering electronic services through gwcoin.com; the conditions of concluding and terminating Electronic Services Agreements as well as the complaints procedure.

  4. By using the Electronic Services available through the Website the User agrees to be legally bound and to abide by the gwcoin.com Terms and Conditions.

  5. All trade names, product names, companies and their logosmentioned on gwcoin.com may be registered trademarks, are the property of their respective owners and are used solely for identification purposes. All materials, descriptions and photos presented on the gwcoin.com website are for information purposes only.

  6. The information on the Website pages does not constitute an offer in meaning of the law.

  7. To all matters not settled herein the following provisions of Polish law shall apply:

  3. Act on Rendering Electronic Services of 18 July, 2002 (Dz.U. no. 144, item1204 as amended)And all other applicable provisions of Polish law.


  1. DEFINITIONS

  1. CONTACT FORM – means the electronic form available on the Website enabling sending a message to the Service Provider.

  2. CONSUMER - means any natural person who, in transactions covered by these Terms and Conditions, is acting for purposes that are outside their business, trade or profession.

  3. LICENSE – means a license agreement as defined in chapter 5 of the Copyright and Related Rights Act of 4 February 1994(Dz.U. no. 24, item 83).

  4. ENTREPRENEUR (NON-CONSUMER USER) - a natural person, legal entity and organizational unit referred to in art. 331 § 1 of the Civil Code, conducting business or professional activity on its own behalf.

  5. TERMS AND CONDITIONS – means these Terms and Conditions.

  6. WEBSITE - means the Service Provider’s Website located at gwcoin.com.

  7. SERVICE PROVIDER – means Magdalena Burzyńska trading as GW COIN Magdalena Burzyńska, ul. Gaj 84, Karniowice, 32-082 Bolechowice, tax identification number NIP: 5511735165, statistical number REGON: 356560068.

  8. USER – means any natural person, a corporate or non-corporate entity granted legal capacity under imperative provisions of law, using the Electronic Services.

  9. ELECTRONIC SERVICE - means any service provided electronically by the Service Provider to the User through the Website.


  1. TYPE AND SCOPE OF ELECTRONIC SERVICES

  1. The Service Provider enables the use of the Electronic Service through the website consisting in using the Contact Form.

  2. These Terms and Conditions shall apply to all Electronic Services provided through gwcoin.com.

  3. The Service Provider reserves the right to display advertising content on the Website.Such content is an integral part of the Website and the materials presented therein.


  1. CONDITIONS OF PROVIDING SERVICES AND CONCLUDING ELECTRONIC SERVICES AGREEMENTS

  1. The Electronic Service set forth in chapter III point1 of these Terms and Conditions is free of charge.

  2. Term of the agreement the Electronic Services Agreement enabling the User access to the Contact Form is concluded for a definite period of time and terminates when the User ceases to use the Service.

  3. End-user hardware, network and software requirements for the ICT system used by the Service Provider:

    1. a computing device, such as PC, smartphone, tablet with an active internet connection,

    2. email address,

    3. Internet browser,

    4. enabling cookies and Javascript in the Internet browser.

  4. The User agrees to use the Website in accordance with the principles of good practice, only for lawful purposes and in a manner which does not infringe the personal rights and intellectual property rights of any third party.

  5. The User is obliged to provide accurate and complete information to the Service Provider.

  6. The User is prohibited from providing any unlawful or illegal content.

  7. The User is obliged to refrain from any actions that they could hinder or interfere with the functioning of the Website and activities on damage to the Service Provider and other entities.


  1. COMPLAINTS PROCEDURE

  1. Complaints procedure for the Electronic Services offered by the Service Provider::

  1. Notice of a product defect and all statutory warranty claims should be submitted via email to:office@gwcoin.com

  2. All claims should contain sufficient detail about the matter that is at issue. Specifically, claims should include information regarding circumstances, the nature of the claim, the date when the issue first arose as well as the issuer contact details.Providing all necessary data will speed up the claim-handling process.

  3. All complaints shall be resolved promptly and in any event no later than within 14 days following the date of receipt.

  4. A response to the complaint shall be sent by email or other preferred method of contact indicated by the complainant.


  1. INTELLECTUAL PROPERTY

  1. The compilation of all content located at gwcoin.com, including name of the Website, its functionalities, graphic appearance, logotypes, graphic elements, layout and composition of these elements (so-called "layout"), trademarks, software and database data uses copyright protection (with the exception of the elements whose rights have been licensed or assigned) is the exclusive property ofMagdalena Burzyńska trading as GW COIN Magdalena Burzyńska, ul. The User shall bear all liability for damages resulting from their use of the content of gwcoin.com without the consent of the Service Provider.

  1. Any use or reproduction of the content of the website gwcoin.com or any portion thereof without the express written consent of the Service Provider constitutes a copyright infringement and is punishable under civil and criminal law.


  1. LIABILITY

        1. The Service Provider shall take all necessary measures to protect Users’ personal information.

        2. The Service Provider shall make every effort to ensure that the content on the Website is complete, up-to date, presented with accuracy and precision, in compliance with all laws and regulations and consumers’ rights.

        3. The Users are solely responsible for any breaches of the law or damages arising out of or resulting from their use of the Website, and in particular Users are solely liable for: submitting false information, disclosing classified data or any data protected by law, infringing personal rights or copyrights and related rights, processing Users’ personal information in violation of the GDPR regulations.

        4. When it be reasonably possible the Service Provider undertakes to warn the Users of any interruption in the functioning of the Website, and in particular of any access interruptions to gwcoin.com.

        5. The Service Provider is not responsible in relation to non-consumer User:

  1. for any damage or loss, directly or indirectly (with the damage fromtitle of loss of business ability, business interruptionsdamageof a financial nature), arising due to use, impossibility of use orincorrect software departmentor IT system, network,

  2. due to improper use of the Website by a non-consumer User and improper functioning of computer hardware,computer software or the access system by means of whichThe Service User connects to the Website system,

  3. in the event of any damage resulting from errors, interruptions in the functioningService or system incorrect data entry or readingcollected by the Users,

  4. classification in the proper functioning of the Website, as well as data lossService Users who are non-consumer or third parties,

  5. in relation to people who are on itlaw or Terms and Conditionsusing data and materials placed in website,

  6. for the inability to log in to the Website system caused in particular by:the quality of the connection, failure of the ICT system or the Construction network,incorrect configuration of the software of the Users who are non-consumer,

  7. for the consequences of losing a password.


  1. FINAL PROVISIONS

  1. Agreements concluded through the Website are construed in accordance with the laws of Poland.

  2. No changes to these Terms and Conditions shall be binding on the User unless the User was duly notified about such changes and did not terminate the electronic services agreement within 14 days of receiving notice of such changes.

  3. Any disputes arising between the Service Provider and the User shall be resolved in the first instance through amicable negotiation between the parties. Should such resort prove of no avail or unsatisfactory to any of the parties, disputes shall be resolved in a court of competent jurisdiction under point (4).

  4. Judicial dispute settlement procedures:

  1. Any disputes arising between the Service Provider and the consumer User shall be resolved by a court of competent jurisdiction, in accordance with the provisions of the Code of Civil Procedure of 17 November 1964 (Dz. U. No. 43, item 296, as amended).

  2. Any disputes arising between the Service Provider and the non-consumer User shall be settled by the court having jurisdiction over the Service Provider’s registered office.

  1. Consumer Users may use Alternative Dispute Resolution schemes after the internal complaints procedure is finalised, such as submitting a request for mediation or a request for arbitration to a competent state organ (model request forms are available at: http://www.uokik.gov.pl/download.php?plik=6223). The list of Permanent Consumer Arbitration Courts attached to the Voivodeship Inspectorates of Trade Inspection may be found at:http://www.uokik.gov.pl/wazne_adresy.php#faq596).The User may also obtain free legal aid provided by the Regional (Municipal) Consumer Ombudsman or a community-based organisation for consumer protection.  Alternative Dispute Resolution procedures are free of charge.
